Very recently our company advertised for a position, this was for one of my co workers from China, company received over 200 resumes, I heard that the new rule is to reply to all the resumes and tell them why they dont qualify etc..

A report from the Leadership Conference on Civil Rights Education Fund shows that hate crimes targeting Hispanics rose 40% from 2003 to 2007. The report can be found here. Lou Dobbs said on Thursday he is considering career options including possible runs for the White House or U.S. Senate. Dobbs has drawn fire from Latino leaders and civil rights groups for frequent on-air remarks about U.S. border control and immigration that critics saw as demonizing illegal immigrants. I personally feel that even considering him for public office will be an insult to the American Public. Let's hope that his plans will remain a far away fiction.

I called USCIS and checked about it. The officer said that she shoul dnot have applied online and made the payment. She should have sent paper application only. And that there was no need to pay any fee. He said that the amount once paid to USCIS can not be refunded back. Ridiculous.

I just checked my status on line and saw a LUD on my and my wife's pending 485 applications. My priority date is March 2006.
One reason that I am thinking off is that i had a service request opened on 8/22 when i went for infopass appointment and I recd a letter from USCIS dated Sept 30th with the usual template of saying that "we are processing your application bla bl bla and if you dont hear anything from us in 6 months please call us bla bla bla....."
However the LUD is not 9/30 but 10/7. I am wondering if anyone else has seen LUDs on their applications.
My AP and EAD have been renewed long back (about 1 month back).
Any response in this respect is appreciated

PERM (labor certification) process is a requirement from the DOL and has to be fulfilled by the employer. The employer will have to bear the costs of this first step in GC which includes (filing fees, recruitment process, lawyer fees etc). It is illegal for an employer to seek this compensation from the employee. Expenses incurred in I-140 and I-485 need not be compensated by the employer.
In your case, it seems that the employer is ready to help you with all the documentation but is not ready to bear the expenses. You will have to explain to your employer how the GC Process works and the requirements of the PERM process.

My mother is a GC holder since 91. I came to US in 2002 on F1 and then H1 and now GC.
Will the fact that my mom was a GC holder and I did not use that impact my GC? I have answered all the questions correctly(true i mean) always.

In my opinion I think we should get the news guys into this and get the information out there about the irresponsibility with which they have mismanaged the whole process. Such kind of problems usually grab headlines when it happens with US citizens.
I think we need to be heard. Imagine, insurance companies violating makes news, social security makes news, airport security regulations and mismanagement makes news _ WHY CANT THIS? THIS IS SO CRUEL. HOW MANY HOURS, MONEY, EFFORT HAS GONE DOWN THE DRAIN? CAN WE NOT GET SOME NEWS CHANNEL TO COVER THIS? SOMEONE TO SPEAK TO A JOURNALIST ABOUT HOW AWFUL IT HAS BEEN????

USCIS has released figures from the first week of the H-1B season and filings for the 65,000 H-1B "regular" cap slots for the fiscal year that begins in October were just 13,500. That is less than one third of the 42,000+ received during the same period last year and only about one-tenth of the number filed two years ago. Only 5,600 masters cap applications were filed against the 20,000 cap in that category.

Gurus,
I am planning to schedule a H1/H4 stamping visa appointment for next month. Here are few questions regarding the vfs web site.
The date I am planning to schedule is still not showing as available. My question
is can I enter all my data and save it and once the date shows up, can I select
the date? How does it work? If not do I need to enter all the data on the day
when it opens up?

Yes it is pretty much recognised for h1b purpose or for any other purpose whatsoever. I got my first h1b approval on the basis of my MBA from IGNOU.

Here is my situation wrt to I 140 and EAD.
1. I am on 6th year of H1 this year and my H1 expires on 30 Sept 2010. I have to apply for H1 extn this year.
2. My employer started GC process (EB3) in 2006 on substitute labor of Aug 2005. He applied I 140 in April 2007.
3. He applied EAD when they are current during June, July 2007 based on substitute labor. I and my wife got EAD eventhough my I 140 is pending.
4. As old I 140 is pending he applied another I 140 with different EB3 labor for me in 2008 and both new labor and I 140 got apporved. He ported my A# of EAD card to this new I 140 showing as beneficiay on it.
5. My old I 140 is still pending and USCIS didnt send any query on that till date. My employer is confident on getting approval of old I 140.
Here are the questions I have:
Can I work on EAD by taking full time jobs by applying AC 21? Does it safe to work on EAD?
If my old I 140 gets any problem what are consequences with my GC process?
Can anybody answer, Please.
